#1 Generative Systems and Security: The Birth of Risk

The talk analyzes how the risk associated with artificial intelligence emerges directly from the technical architectures of modern systems and how this risk translates, seamlessly, into legal liability.

The first part examines AI systems as infrastructural components: data pipelines, generative models, LLMs, RAG, and automated agents. The main failure modes are illustrated — prompt injection, data leakage, model extraction, and the offensive use of AI in cyberattacks — showing how AI modifies the scale, speed, and asymmetry of digital conflict.

The second part reconstructs the transition from technical risk to legal risk. Vulnerabilities are not treated as accidental events, but as predictable outcomes of design choices. On this basis, the AI system is framed within the scope of the AI Act, linking architecture, predictability of harm, security obligations, and criteria for the attribution of liability.

The talk provides a unified interpretation: the law does not intervene despite the technical complexity of AI, but because of it. Risk is born in the code, even before it is in the regulation.
